CloudOwner LLC

These Terms of Service (“Terms”) govern your use of the CloudOwner LLC website at cloudowner.io, the client portal, and any related pages and communications (together, the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
These Terms govern the Site only. If you become a client, the services we provide to you are governed by a separate Master Services Agreement and its Schedules. If there is any conflict between these Terms and a signed services agreement, the services agreement controls.
Who we are
CloudOwner LLC is a California limited liability company located at 3815 Bayer Avenue, Long Beach, California 90808. We provide managed hosting, managed desktop, and secure computing environments to businesses.
Use of the Site
You may use the Site for lawful business purposes. You agree not to:
Attempt to gain unauthorized access to any part of the Site, the client portal, or any system operated by CloudOwner
Probe, scan, or test the vulnerability of the Site or any related system without our written permission
Interfere with the operation of the Site or any other user’s access to it
Use automated tools to collect data from the Site beyond what is available through normal browsing
Submit false, misleading, or fraudulent information
Use the Site to transmit malware, spam, or any unlawful content
We may suspend or terminate access to the Site or the client portal for anyone who violates these Terms.
Client portal accounts
If you have a client portal account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately if you believe your account has been compromised. We may require multi-factor authentication for portal access and may suspend accounts that show signs of unauthorized use.
Intellectual property
The Site and its content, including text, graphics, logos, and design, are owned by CloudOwner LLC or its licensors and are protected by copyright and trademark law. You may view and print pages for your own business evaluation. You may not copy, reproduce, modify, distribute, or use any Site content for commercial purposes without our written permission. The CloudOwner name and logo are trademarks of CloudOwner LLC.
Information on the Site
Information on the Site is provided for general purposes and is not legal, regulatory, or compliance advice. Descriptions of our services, pricing, and capabilities are subject to change and are superseded by any signed agreement. References to regulatory frameworks, including NIST SP 800-171, DFARS, and CMMC, describe how our services are designed and do not constitute a representation that any client is or will be compliant with any requirement. Compliance obligations remain with the contractor.
No warranty for the Site
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, CLOUDOWNER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, CLOUDOWNER LLC IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE IS LIMITED TO ONE HUNDRED DOLLARS ($100). THIS SECTION DOES NOT LIMIT LIABILITY UNDER ANY SIGNED SERVICES AGREEMENT, WHICH IS GOVERNED BY THAT AGREEMENT’S OWN TERMS.

The Site may link to third-party websites. We do not control those sites and are not responsible for their content or practices. Links are provided for convenience and do not imply endorsement.
Privacy
Our collection and use of personal information through the Site is described in our Privacy Policy, which is incorporated into these Terms by reference.
Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute arising from the Site will be brought in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
Changes to these Terms
We may update these Terms from time to time. The effective date at the top indicates when they were last revised. Continued use of the Site after a change constitutes acceptance of the revised Terms.
